Terms of Sale
Thank you for your interest in making a purchase through stompstickers.com (“Site”.) These Terms of Sale (“Terms of Sale”) govern your purchases on our Site.
We do not sell products through our Site to persons under the age of 18. If you are under the age of 18, you should ask an adult to make the purchase for you.
Every order that you place on our Site will be subject to acceptance in accordance with these Terms of Sale. The final details of your order will be listed at the end of the checkout process. Following completion of the checkout process, we will send you an email confirming receipt of your order, detailing the products you have ordered with an order number, and setting forth the shipping address and delivery method for your order. This email is not an order acceptance from us, and your order will not be completed and accepted until we notify you that it has been shipped. Please inform us immediately if there are any errors in your order.
Once we have processed your order, we will send you an email confirming that your order has been shipped (the “Shipping Notification”). You should save the Shipping Notification for your own records. The Shipping Notification will be deemed to be completion of your order. Any products on the same order which we have not confirmed in the Shipping Notification will not form part of that order. Completion of the order will also not take place where we have notified you that we cannot accept your order.
Orders can only be shipped to the lower 48 United States. We do not accept orders for delivery outside the United States. Orders that ship free will be sent via UPS Ground service.
Certain orders might not meet our production standards and will require additional information or verification before they can be processed. We reserve the right to cancel any order at our own sole discretion. We will contact you if any part of your order does not meet our production standards. Any corresponding refunds will be issued to the credit card used to place the order.
We respect the Intellectual Property rights of others. In designing and ordering Products (“Products”) through this Site, you agree that you are the owner or have been granted rights of any copyrights, trademarks or other Intellectual Property that may be featured on your Products ordered. You further agree that you will indemnify, defend and hold harmless Stomp, its officers, directors, employees, agents, and Affiliates from and against any damages, penalties, costs, and expenses (including reasonable attorney fees) incurred in connection with any claims or actions by a third party relating to its Intellectual Property.
We do not claim any copyrights or other Intellectual Property rights in the Stickers you design and order through this Site. However, by submitting an order you are granting us and our subsidiaries, affiliates, successors and assigns, a nonexclusive, fully paid, worldwide, perpetual, irrevocable, royalty-free, transferable license (with the right to sublicense through unlimited levels of sublicensees) to use, copy, modify, distribute, publicly display and perform, publish, transmit, remove, retain repurpose, and commercialize your Stickers in any and all media or form of communication whether now existing or hereafter developed, without obtaining additional consent, without restriction, notification, or attribution, and without compensating you in any way, and to authorize others to do the same.
MOBILE TERMS OF SERVICE

The Stomp Stickers mobile message service (the "Service") is operated by Stomp Stickers (“Stomp Stickers”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Stomp Stickers’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Stomp Stickers through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Stomp Stickers. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18335990683 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Stomp Stickers mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

We will take payment from your credit card at the time your order is submitted (by clicking on “Complete Order.”) If we are unable to process your order for any reason, we will notify you and refund your credit card the amount of the charge.
All prices are in US Dollars. Prices shall be those published on this Site at the time you complete your order. The total price stated on the order form you submit shall be the total amount payable by you for the product including all taxes, handling and shipping charges.
We are very careful, but sometimes errors occur. All errors are subject to our correction. We reserve the right to change prices and specifications without notice. The price that you pay for any product on our Site will be the price that is published on the Site at the final page in the checkout process. Placing an item in your shopping cart does not reserve the price shown at that time. We cannot confirm the price of a product until you have completed the order.
If a stated price is determined by us in our sole discretion to be in error, we are not under any obligation to offer you the product or service at that price. We will notify you of the error and give you the opportunity to request a cancellation of your order and obtain a refund if payment has occurred.
We reserve the right to cancel any order at any time for any reason under our sole discretion. Customer’s request to cancel an order can occur at any time before the proof has been approved. Please contact us as soon as possible with any cancellation request.
In the event that your order is cancelled, we will notify you via email at which time the credit card used to process the order will be refunded.
SHIPPING POLICIES AND DELIVERY
Shipping and handling charges listed on our Site apply to the contiguous United States only. We do not currently offer shipping to foreign countries.
Products will be delivered to the address specified in the order. Any delivery or shipment dates we provide are best estimates only and we shall not be liable for any loss, damage, costs or expenses for failure to deliver in accordance with the delivery or shipment dates given.
We stand behind our products and want you to be completely satisfied. If you are not completely satisfied for any reason, please contact us within 30 days of receipt. We likely will need your assistance in making sure you are satisfied. At times we might ask for photographs of the product or more information from you. In the rare case we are unable to delight you with our products or service and a refund is required, the refund will be issued to the original credit card. It may take up to 30 to 60 days to appear on your credit card statement.
These Terms of Sale are personal to you and you may not assign or otherwise transfer any right or obligation under these Terms of Sale except as permitted herein. We reserve the right to transfer, assign, license or subcontract all or any of our rights or obligations under these Terms of Sale or any related contract to any third party.
We will not have any liability to you or be deemed to be in breach of these Terms of Sale from any circumstances which are beyond our reasonable control (including a delay in delivery caused by force majeure)."Force majeure" includes, without limitation, circumstances directly or indirectly resulting from acts of God; acts of the public enemy; strikes; lockouts; epidemic and riots; power failure; fire; earthquake; water shortage or adverse weather conditions; or other causes beyond our control.
We reserve the right to make changes to these Terms of Sale at any time. You will be subject to the Terms of Sale in force at the time you place your order with us, unless any change to these Terms of Sale is required to be made by law (in which case it will apply to any orders previously placed by you).
